The present petition was disposed of by an order dated 13.10.2017 directing the Adjudicating Authority to consider the petitioner's application which was then listed on 17.10.2017.

The petitioner states that the said application has not been decided as yet and is now listed on 16.11.2017. 2.

The petitioner and his mother are owners of the property bearing house no.255, Sainik Vihar, Pitampura, New Delhi. The said property has been provisionally attached to the extent of 50% (that is the petitioner's share in the said property). The petitioner and his mother have already sold two floors of the said built up property for paying the dues of India Bulls Housing Finance Ltd. However, two floors still remain in the possession of the petitioners and his mother. Since the attachment is only to the extent of

50%, the petitioners request that the NOC for the floors that have been sold be given and they be released from attachment. In view of the same, the remaining floors be provisionally attached. The petitioner further states that his mother will give an undertaking to suffer the attachment and any further order(s) that may be passed.

He states that if necessary, the petitioner's mother will also file a relinquishment deed in favour of the petitioner once a final order has been passed.

The petitioner's application is limited to the aforesaid extent. The Adjudicating Authority is directed to consider the petitioner's application as expeditiously as possible and in any event within a period of two weeks from today.

The application is disposed of with the aforesaid directions. 5.
