This suit is allowed to be withdrawn as prayed as on the same cause of action arbitration proceedings are going on between the parties and which arbitration proceedings can be pursued by the plaintiff.

It is also agreed that the suit is allowed to be withdrawn subject to payment of costs of Rs.1 lakh to Help Age India, C-14, Qutab Institutional Area, New Delhi, Delhi 110016, within a period of four weeks from today and receipt of costs be filed in this Court within two weeks thereafter with a copy of the same to counsel for the defendant.
