% 03.11.2016 CM No.40510/2016 in RC.REV. 647/2015 On 5.2.2016 a consent order was passed that the suit property bearing No.82A, Main Bazar, Najafgarh, New Delhi shall be vacated by the petitioner on or before 5.11.2016. He was also asked to file an affidavit by way of an undertaking.

The petitioner has filed an undertaking to this court to vacate the suit property on or before 5.11.2016.

The present application is filed seeking to extend the time for vacation of the shop by three months beyond 5.11.2016. The only ground given in the application is that the petitioner is a 70 year old person having four children and not physically capable of shifting his shop to some other place. It is a rented shop and his only source of income and the applicant needs additional time.

These are facts which were known to the applicant/petitioner when he entered into the compromise and consent order was passed on 5.2.2016 and RC.REV.647/2015

an Affidavit-cum-Undertaking to vacate on or before 5.11.2016 was furnished. No grounds are made out. There is no merit in the present application. Same is dismissed.
