% 07.07.2017 CA No.248/2017 This application is for restoration of the company petition. It is submitted that the matter was amicably settled between the parties on 12.12.2015 before the Delhi High Court Mediation and Conciliation Centre and that as per the settlement the respondent was to pay an amount of Rs. 8,71,316/- to the petitioner by June of 2016, in the manner stated in the annexure C annexed. As per clause (c) of the said settlement the respondent was also to pay an interest @ 18% per month to the petitioner on the delayed instalments and in case of default. It is submitted by the learned counsel for the respondent that today the respondent as brought a cheque of Rs. 1 lakh which has been handed over to the learned counsel for the petitioner on an undertaking of the respondent Mr. Vihshal, Manager of the

respondent company that the cheque shall be encashed on presentation. The balance amount, it is submitted, shall be paid within two months.
