% 10.01.2019 Learned counsel for the petitioners states that he does not wish to file any rejoinder affidavit. He also points out that though this Court has vide its order dated 24th November, 2018, only restrained that the respondent no.2 to 4 from doing any unauthorised construction including installation of any structures including iron/steel structures/girders, pillars, columns and/or iron/steel sheets behind and adjacent to the windows of the building block of the petitioner's property being Property No.2, Alipur Road, Shamnath Marg, Civil Lines, Delhi, the said direction is being construed as an order of status quo prohibiting the respondent no.1 also from taking any action as per law.
Mr.Mukesh Gupta, learned counsel for the respondent no.1
states that the respondent no.1 is not reading the order in the manner as apprehended by the learned counsel for the petitioners. He states that the respondent no.1 is well aware of its statutory duty and is taking appropriate action as per law. He further states that the respondent no.1 has, based on a reply submitted by the respondent no.2 to the notice issued by respondent no.1, decided to give a personal hearing to the said respondent before taking any final decision and the respondent no.2 has already been directed to appear through its authorised representative before the concerned Assistant Engineer on 11th January, 2019. It is expected that the concerned Assistant Engineer will take an expeditious decision as per law. At request, list on 14th February, 2019.
