% 07.11.2017 Crl. M. A. No.18159/2017 This is an application under Section 482 read with Section 439 of the Code of Criminal Procedure, 1973 (in short „Cr.PC‟) for interim bail till the disposal of main bail petition.
A compromise has been arrived at between the parties. Today, two Demand Drafts No.925262 and 925263 for an amount of Rs.5,00,000/- (Rupees Five Lakh only) and Rs.11,00,000/- (Rupees Eleven Lakh only) dated 07.11.2017, drawn on Andhra Bank, 1718, Paschin Vihar Branch, New Delhi-110087 and one cheque no.159420 dated 09.11.2017 for an amount of Rs.4,00,000/- (Rupees Four Lakh only) have been handed over by the counsel for the petitioner to counsel for respondent/complainant. An application for interim bail on medical ground is pending consideration.
Fresh report dated 06.11.2017 has been filed. Counsel for the petitioner submits that the father of the petitioner is seriously ill and requires liver transplantation as detailed in the application. It is further submitted by the counsel for petitioner that condition of the father of the petitioner is extremely serious. Counsel for petitioner further submits that Mr.Banwari Lal Kaushik, father of the petitioner is admitted in medical ICU of Jaipur Golden Hospital.
Keeping in view the aforesaid facts and circumstances and medical condition of father of the petitioner, the petitioner/applicant be released on interim bail till 13.11.2017 subject to the following conditions: (i) That the petitioner shall furnish a personal bond in the sum of Rs.30,000/- with one surety of the like amount subject to the satisfaction of the Trial Court.
(ii) That the petitioner shall not directly or indirectly make any threat, inducement or promise to any witness in order to hamper the trial proceedings.
(iii) That the petitioner shall not leave the country without the permission of the Court.
