O R D E R

% 05.02.2018 By this petition the petitioner challenges the communication dated 14th July, 2017 declining to grant parole to the petitioner which he has sought on the ground to get himself treated about his ailment in the mouth, attend Barsi ceremony of his late mother fixed on 12th July, 2015 and reestablish social ties. A nominal roll has been handed-over by learned Additional Standing Counsel for the State which is taken on record. As per the nominal roll the petitioner was granted parole for a period of one week with effect from 13th July, 2017 to 20th July, 2017 and thereafter the petitioner was also granted furlough by DG Prisons with effect from 25th August, 2017. Thus, at the time when the petitioner was seeking release on parole for the treatment he was granted one week parole and two weeks furlough. Therefore, W.P.(CRL) 2866/2017

this Court finds no ground to interfere in the communication of the competent authority.

Petition is dismissed.

Needless to state that in case the petitioner deems it fit with the change in circumstance and has right to be released on parole/furlough, he would be at liberty to apply afresh to the competent authority. Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
