% 09.04.2018 Notice could not be issued to respondent no. 2 as process fee was not filed. However, Mr. Bhupinder Singh, father of respondent no. 2 is present in Court. In fact, respondent no. 2 is minor and is being represented by her father, namely, Mr. Bhupinder Singh.

Mr. Bhupinder Singh has been identified by SI Baljit Singh of police station Punjabi Bagh. He says that matter has been settled with the petitioner of his own free will, voluntarily and without any undue force, pressure or coercion, vide a Settlement Deed dated 7th September, 2017 (Annexure P-3).

Father of respondent no. 2 says that he has taken instructions from his daughter Ms. Manisha; therefore,

neither he nor his daughter has any objection in case FIR No. 295/2017 under Sections 354/354(D)/323/506 IPC and Section 12 of the Protection of Children from Sexual Offence Act, 2012 registered at police station Punjabi Bagh are quashed. Affidavit of Mr. Bhupinder Singh is also on record. Keeping in mind the settlement arrived at between the petitioner and respondent no. 2, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.295/2017 under Sections 354/354(D)/323/506 IPC and Section 12 of the Protection of Children from Sexual Offence Act, 2012 registered at police station Punjabi Bagh and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
