% 23.10.2017 Mr. Bindu Das, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to approach the learned Debts Recovery Appellate Tribunal, Delhi (DRAT), with an application to dispose of IA Nos. 508/2017 and 509/2017 in Appeal No. 296/2017; emanating from OA No. 161/2012 titled as "Anurag Gupta vs. Phoenix ARC Pvt. Ltd.", pending adjudication before that forum, expeditiously. Leave and liberty granted.

Petition is dismissed as withdrawn and disposed off accordingly. Needless to state, that the application seeking waiver of pre-deposit as a condition to hear the appeal, will be determined by the DRAT as expeditiously as possible.
