% 16.11.2017 The petitioner has prayed for interim bail so as to enable the petitioner to attend to his wife who has to undergo operation in her lumber region. The assertions of the petitioner have been verified and have been found to be true.
Mr.Mukesh Gupta, learned advocate for the petitioner has informed this Court that on earlier occasions, also the petitioner was released on interim bail and on every occasion, he had surrendered before the jail authorities on or before the end of such period of interim bail. The wife of the petitioner has to be operated upon on 23.11.2017 in Sakshi Hospital at Kanpur.
The petitioner has remained in jail since 07.11.2015. The trial in this case is in progress.
Taking into account the assertion of the petitioner that there is nobody
in his family to look after his wife during the period of operation, this Court is inclined to release the petitioner on interim bail for a period of 15 days. The petitioner is directed to be released on interim bail for a period of 15 days, to be counted from the date of his release, on his furnishing bond in the sum of Rs.10,000/- with one surety of like amount to the satisfaction of the Trial Court.
The petitioner shall, however, be subject to the condition that at the time of furnishing his bond, she shall tender his and his surety's mobile telephone numbers which shall be kept in operative condition. The petitioner shall be required to surrender before the jail authorities on or before the end of the period of interim bail. The application is disposed of accordingly.
The order be communicated to the Superintendent of the concerned jail for compliance and record.
