versus THE STATE GOVT OF NCT OF DELHI & ANR ..... Respondents Through Ms. Manjeet Arya, APP with SI Hira Lal, P.S. Moti Nagar for the State Mr. Amit Srivastava and Mr. Joginder Singh, Advs. with respondent no. 2 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 29.11.2017 Respondent no. 2 Ms. Charu Gola is present in Court along with her counsel and has been identified by SI Hira Lal, Police Station Moti Nagar. It is submitted that petitioner No.1 (husband) and respondent No.2 (wife) have resolved their differences amicably. Respondent no. 2 says that she has rejoined the petitioner no. 1 about three years ago and has no complaint against him.

Respondent no. 2 admits having settled the matter with the petitioners of her own free will and without any undue force, pressure or coercion.

She further submits that she is not willing to pursue the FIR

against the petitioner no. 1 and his relatives, that is, petitioner nos. 2 to 5 any further and the same may be quashed.

Keeping in mind that husband and wife have resolved their differences and have started living together, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, FIR No.209/2013 under Sections 498-A/406/34 IPC registered at Police Station Moti Nagar and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of in the above terms. Dasti.

A.K. PATHAK, J.
