By way of this application filed under Section 439 Cr.P.C., the petitioner is seeking regular bail in case FIR No.9/2017 under Section 302/498-A IPC, PS Mandavali Fazalpur, Delhi.

Vide order dated 31st October, 2017, the petitioner was granted interim bail for a period of one month for medical treatment of his mother, stated to be suffering from heart problem.

Petitioner is present in person along with his counsel. 4.

Today learned counsel for the petitioner seeks extension of interim bail to complete the treatment of his mother. Learned counsel for the petitioner further submits that petitioner has to shuttle between Bihar and Delhi for the reason that the co-accused, who is his brother as well husband of the deceased, is in custody and the mater comes up for hearing at the interval of fourteen days.

Looking into the facts and circumstances of the case and medical condition of the mother of the petitioner, I find it to be a fit case to extend the period of interim bail granted to the petitioner vide order dated 31st October, 2017. Accordingly, the interim bail granted to the Appellant is further extended for a period of four weeks on the same terms & conditions as mentioned in order dated 31st October, 2017. The Appellant is directed to surrender before the Jail Authorities after expiry of the period. 6.

Since the petitioner is involved in a case under Section 302/498A IPC, the petitioner is also at liberty to seek exemption from the learned Sessions Court by not disputing his identity so that he can get his mother treated in Bihar.

The petition stands disposed of accordingly.

A copy of this order be given dasti to counsel for the Appellant, as prayed.
