% 08.01.2018 By this petition the petitioner seeks parole for filing an SLP. The petitioner was convicted for an offence punishable under Section 308 IPC and awarded sentence of simple imprisonment for a period of three years out of which he has already undergone imprisonment of one year and 21 days. The jail conduct of the petitioner has also been satisfactory. It is also revealed that the wife of the petitioner is residing at her parental home with her daughter who is suffering from paralysis. Merely because after the dismissal of the appeal, the petitioner surrendered late cannot be a ground to deny him parole especially when there is no verification done by the State as to whether the appellant was present when his appeal was heard by this Court and decision rendered. Consequently, it is directed that the petitioner be released on parole W.P.(CRL) 2916/2017
for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM. Petition is disposed of.
A copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
