This is an appeal filed against a judgment and decree dated 31.08.2018 passed by the learned Additional District Judge-01, South East District, Saket Courts, New Delhi ('impugned judgment'). It is stated by the learned counsels appearing for the parties that they have settled the matter and the Respondent has received the amount in question and, therefore, the impugned judgment be set aside. 2.
Mr. Malik, learned counsel appearing for Mr. Narender Makhija, who is stated to be the Power of Attorney Holder of Mr. Gurpreet Singh Bhattal, the Respondent herein, states that the part sale consideration was received by the said Power of Attorney Holder on behalf of Mr. Bhattal and it was subsequently passed on to Mr. Bhattal.

that an affidavit dated 23.01.2023 has been filed stating that no amount is receivable from the said Power of Attorney Holder, Mr. Narender Makhija.

Learned counsel appearing for the Appellant states that the Appellant has also filed an affidavit, which is lying under objection, to record that no amount is due from Mr. Narender Makhija. In view of the statement made on instructions by the learned counsel for the Appellant, the appeal is disposed of with the following directions: - i.
The judgment and decree dated 31.08.2018 passed by the Court of the Additional District Judge-01, South East District, Saket Courts, New Delhi in CS No. 9995/16 titled 'Gurpreet Singh Bhattal v. Anguri Devi and Anr.' is set aside.
ii.
It is clarified that no amount is due or pending from Mr. Narender Makhija, either to the Appellant or the Respondent.

There is no order as to costs.
