O R D E R

% 19.03.2018 By this petition, the petitioner seeks quashing of FIR No.345/2015 under Sections 448/420/468/471 IPC registered at PS Dwarka Sector 23, New Delhi on the complaint of respondent No.2 and the proceedings pursuant thereto on the ground that parties have settled the matter. Learned proxy counsel for the learned Additional Standing Counsel, on instructions, submits that in the above noted FIR petitioner is the only accused and respondent No.2 is the only complainant. Respondent No.2 is present in Court and is identified by the Investigating Officer and states that he has settled the matter with the petitioner vide compromise deed dated 9th August, 2017, copy whereof is annexed as Annexure 'C' to the present petition. In terms of the settlement, the respondent No.2 recognizes the right of the petitioner to half share in

equal part of Plot No.155 admeasuring 120 sq. yards in Khasra No.5/1 situated in the area of village Pochanpur, New Delhi. He further states that he does not wish to pursue the above notice FIR and the proceedings emanating pursuant thereto and undertakes to abide by the terms of the settlement arrived at between the parties.

The petitioner, who is present in Court, and is identified by the learned counsel for the petitioner affirms the statement of respondent No.2 and undertakes to abide by the terms of the settlement arrived at between the parties.

In view of the fact that the parties have amicably resolved their differences of their own free will, violation and without any coercion and no useful purpose will be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.345/2015 under Sections 448/420/468/471 IPC registered at PS Dwarka Sector 23, New Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

The petition is disposed of.
