% 16.03.2016 The learned counsel for the petitioner says that he has instructions to withdraw the captioned petition in view of a settlement arrived at with the respondent.

The learned counsel for the petitioner says that three post dated cheques (PDCs) have been issued in that behalf for a total sum of Rs.29,10,565/- .

The details of the same are as follows :- (i). cheque no.702856, dated 10.04.2016, in the sum of Rs.10 Lakh; (ii). cheque no.702857, dated 10.05.2016, in the sum of Rs.10 Lakh; and (iii). cheque no.702859, dated 10.06.2016, in the sum of Rs.9,10,565/-. All three (3) cheques drawn on SBI and favour the petitioner. In these circumstances, the captioned petition and the pending application are dismissed as withdrawn.

At this stage, the learned counsel for the petitioner seeks liberty to CO.PET. 752/2015

revive the petition in case there is a breach of settlement by the respondent. Liberty in that behalf is given to approach the court; albeit in accordance with law.
