% 16.11.2017 This writ petition seeks quashing of FIR No. 687/2015 registered under Sections 406/498-A/34 IPC at P.S. Rajouri Garden, Delhi. The FIR was filed by Ms. Sonia Chawla daughter of Mr. Khairati Lal Chawla on the basis of matrimonial discord alleging cruelty and domestic violence. The lis has been amicably settled by her with all persons concerned, by way of a settlement deed dated 28.11.2016 which has been placed on record. The parties are present in the Court today.
They have been identified by their respective counsel and they reiterate the terms of the agreement and undertake to
abide by the same. Their undertaking is accepted. The marriage has been dissolved by way of a decree of divorce dated 01.08.2017. Ms. Sonia Chawla is to receive an amount of Rs.5,60,000/- of which only an amount of Rs.1,00,000/- remains to be paid, this amount has been received by her in the Court today through her counsel. In view of the fact that she has settled all her claims with the petitioners and does not wish to pursue the complaint any further, the substratum of the FIR is largely removed and any further proceedings arising therefrom would be an exercise in futility.
In the circumstances the Court is of the view that FIR No. 687/2015 registered under Sections 406/498-A/34 IPC at P.S. Rajouri Garden, Delhi and all proceedings emanating therefrom be quashed. It is so ordered.
