% 11.02.2020 At the onset, Mr. Srivastava, ld. counsel for the applicant in C.M. No. 2127/2020 comes forward to point out that his presence has come to be recorded on behalf of the petitioner instead of the applicant. Taking note of the submissions made, it is directed that the proceedings of last date i.e. 20.01.2020 shall be read for presence of Mr. Srivastava for the applicant in C.M. No. 2127/2020 instead of the petitioner in the contempt petition.

CONT.CAS(C) 725/2017 & CM APPL. 2127/2020 (for directions) The instant petition came to be filed alleging violation of the order dated 21.02.2019 passed by the ld. Single Judge in W.P. (C) 1546/2017

Kamran Malik v. South Delhi Municipal Corporation & Ors., which, reads as under:

A perusal of the status reports dated 14.05.2016, 24.07.2019 and 10.01.2020 shows that the sealing and demolition actions have come to be taken by the officials of the respondent - South Delhi Municipal Corporation for the unauthorized construction that took place in the subject premises. Now, by C.M. No. 2127/2020, the applicant, who claims to be the owner of the subject premises, in effect, intends to seek regularization of the existing structure.

Taking note of the totality of facts and circumstances, the Court considers that no further action is called for in the instant proceedings. The contempt petition along with pending applications stands disposed of. It is however made clear that any observation made by the Court in the instant proceedings shall have no bearing on the application that might be filed by the applicant for regularization and/or construction, to which the applicant may be entitled to in accordance with law.
