CORAM:
HON'BLE MR. JUSTICE SUNIL GAUR
O R D E R
% 10.04.2019 Impugned order of 9th October, 2017 grants permission to respondent-accused to travel abroad for fifteen days, subject to respondent-accused furnishing fixed deposit receipt of ₹50,000/- with a surety undertaking that he has no objection to respondent-accused going abroad.
The apprehension expressed by learned counsel for petitioner is that respondent-accused is a Travel Agent and he is likely to abscond if he is allowed to go to Slovenia.
Learned counsel for respondent-accused submits that petitioner has a local surety, who will ensure that respondent-accused returns back in time.
Crl.M.C. 4193/2017
Upon hearing and on perusal of impugned order, I find that to secure return of respondent-accused in time, FDR amount needs to be suitably enhanced from ₹50,000/- to ₹5,00,000/- and a sound surety be furnished, who shall also furnish bank guarantee or the like of ₹5,00,000/- to the satisfaction of trial court.
In view of aforesaid, impugned order is accordingly modified and it be complied with subject to verification of respondent's address in Slovenia.
This petition and application are accordingly disposed of. Dasti.
