% 28.01.2019 None appears on behalf of the petitioner today. The petitioner did not appear even on the last date of hearing. Learned counsel for the petitioner had sought an adjournment on the last date of hearing for today, so as to enable the petitioner to make a statement and give an undertaking to the Court that the petitioner shall vacate the premises within three months and hand over the possession of the same to the respondent-Bank and also that the petitioner will pay to the respondent-bank, the amount, which would, otherwise, have been payable to the borrower/landlord on the condition that the respondentBank may receive the amount without accepting the same as rent. In the aforesaid position, we dismiss the writ petition in default and for non-prosecution.
