% 12.03.2019 BAIL APPLN. 2089/2017 & Crl.M.(Bail) 1821/2017 (for interim bail) 1.

After some arguments when this Court was not inclined to accept the plea of the petitioner, learned counsel for the petitioner submits that he has instructions from the petitioner that in case directions are issued for expeditious disposal of the trial, he shall not press the present application at this stage.

Keeping in view the totality of facts and circumstances of the case and the fact that the petitioner has been in custody since 23.12.2016 and the fact that the witnesses remaining are formal/official witnesses, the Trial Court is directed to expedite the recording of the prosecution evidence and endeavour to conclude the same within a period of 6 months from the next date of hearing before BAIL APPLN. 2089/2017

the Trial Court.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is, accordingly, dismissed as withdrawn with the aforesaid directions.

Copy of the order be also forwarded to the Trial Court for compliance.
