% 01.12.2017 In spite of service on the respondents, none appears for the respondents. They are proceeded ex-parte.

This court vide its interim order dated 16.10.2017, had restrained the respondents from selling, alienating or transferring the property No. 333, 33th Floor, Tower C, DLF, The Crest Zone 11 & 12 DLF City Phase V, Sector 54,Gurgaon, Haryana-122001, mortgaged to the petitioner. As none has appeared for the respondents, the interim order is confirmed.

I am informed that the petitioner is in the process of taking steps for appointment of an Arbitrator in accordance with the Arbitration Agreement between the parties. It will be open to the Arbitrator to modify/vacate the interim order in accordance with law. All contentions of the respondents, in this regard, are kept open. The petition is disposed of in the above terms.
