..... Petitioners Through Ms. Annu Sharma, Adv with petitioners in person
Versus
THE STATE (NCT OF DELHI) & ANR.
..... Respondents Through Mr. Izhar Ahmad, APP for State SI Ramesh Kumar, PS Sultan Puri Respondent no.2 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 20.09.2018 Respondent no.2 is present in Court and has been identified by SI Ramesh Kumar of police station Sultan Puri. It is submitted that petitioner no. 1 (husband) and respondent nos. 2 (wife) are living together for the last about 3 years after resolving marital discord between them. Respondent no.2 says that she is not willing to pursue criminal proceedings against petitioner no.1 and his relatives, that is, petitioner nos. 2 to 4. Therefore, FIR No.1074/2015 under sections 498-A/406/34 IPC registered at police station Sultan Puri and consequent proceedings emanating therefrom may be quashed against the petitioners.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful
purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
Dasti.
