O R D E R

% 17.01.2017 (1) The petitioner seeks anticipatory bail under Section 438 read with Section 482 Cr.P.C. in case FIR No. 39/2014 under Sections 498-A/406/34 IPC registered at Police Station Nanakpura. Status report is on record.

(2) I have heard the learned counsel for the parties including counsel for the complainant and have examined the file. Certain dowry articles have been returned. However the complainant submits that all the dowry articles have not been returned. (3) During the course of arguments, petitioner's counsel on instructions volunteered to pay `1,00,000/- to the complainant without prejudice and subject to future adjustment (if any) towards dowry

articles. On this the complainant, who is present, has no objection to the grant of bail.

(4) Considering the facts and circumstances of the case and petitioner's offer to pay `1,00,000/-, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.

(5) The petitioner shall pay `1,00,000/- to the complainant through Investigating Officer within two weeks and this payment shall be without prejudice and subject to future adjustment (if any). In case of non-compliance the complainant will be at liberty to approach this court.

(6) The bail application stands disposed of.
