IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4593/2017 DHARMENDRA KUMAR & ORS ..... Petitioners Through:

Mr. Abhishek Kukkar, Adv.

versus GOVT OF NCT OF DELHI & ANR ..... Respondents Through:

Ms. Manjeet Arya, APP for State with SI Jitender, P.S. Model Town.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 09.11.2017 Respondent no.2 is present in Court and has been identified by SI Jitender of police station Model Town. She submits that she has settled the matter with the petitioner no.1 voluntarily and started living with him. She further submits that she has been living with the petitioner no.1 for more than three years, therefore, she is not willing to pursue the FIR any further and the same may be quashed qua petitioner no.1 and his relatives, that is, petitioner nos. 2 to 4.

Keeping in view that husband (petitioner no.1) and wife (respondent no.2) have started living together after ironing out their differences, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, FIR No. 165/2013 under Sections 498A/406/34 IPC registered at police station Model Town and the consequent proceedings

emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.

Dasti.
