The counsel for the decree holders states that in pursuance to the warrants of possession, possession has been received on 29th January, 2016 and the execution stands satisfied.

The counsel for the judgment debtor states that he has already filed an application under Order IX Rule 13 of Code of Civil Procedure, 1908 (CPC) and which is pending consideration and listed next on 5th September, 2016; else it is not disputed that in execution, possession has been recovered. 3.

The pendency of the application under Order IX Rule 13 CPC is no ground for keeping this execution pending.
