% 06.11.2017 CRL.M.A. 17031/2017 Allowed, subject to all just exceptions. Application is disposed of. CRL.M.C. 4245/2017 Respondent no. 2 is present in Court along with his counsel and has been identified by SI Jagjit Singh of Police Station New Friends Colony. Respondent n. 2 alleged in the FIR that petitioners had taken `1,05,000/- from him on the pretext that they will obtain a work visa in Saudi Arabia. However, they failed to obtain work visa. On these allegations, FIR No. 306/2017 under Sections 420/406/506/34 IPC was registered at Police Station New Friends Colony. It is submitted that respondent no. 2 and petitioners have now settled
their disputes amicably, inasmuch as petitioners have refunded the amount to the respondent no. 2 taken from him. He says that he has settled the matter with the petitioners of his own free will, voluntarily and without any undue force, pressure or coercion.
He admits having received the amount of `1,05,000/- from the petitioners. He submits that he is not willing to pursue the FIR any further and the same may be quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, in the interest of justice FIR No. 306/2017 under Sections 420/406/506/34 IPC registered at Police Station New Friends Colony, which is at the investigation stage, is quashed, subject to costs of `25,000/- each to be deposited by the petitioners with Prime Minister Relief Funds within two weeks.
Receipts, evidencing deposit of costs, be submitted with the Investigating Officer thereafter.
Petition is disposed of in the above terms.
