IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 4664/2017 RAJENDER NEGI & ANR ..... Petitioners Through Mr. Deepak Arora, Adv.
versus STATE OF NCT OF DELHI & ANR .... Respondents Through Ms. Meenakshi Chauhan, APP with ASI Ombir Singh, P.S. Dabri for respondent no. 1 Respondent no. 2 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 14.11.2017 Respondent no. 2 (wife) and petitioner no. 1 (husband) are present in Court and have been identified by ASI Ombir Singh of Police Station Dabri. Respondent no. 2 says that she has settled the matter with the petitioner no. 1 of her own free will, voluntarily and without any undue force, pressure or coercion. It is submitted that after resolving their differences, petitioner no. 1 and respondent no. 2 have started living together since 1st January, 2015. She submits that she is not willing to pursue the FIR any further against the petitioner no. 1 and his relative, that is, petitioner no. 2 and the same may be quashed.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice FIR No.541/2014 under Sections 498-A/406/506/34 IPC registered at Police Station Dabri and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
