O R D E R

% 16.10.2018 Respondent no.2 is present in Court and has been identified by ASI Devender Kumar of police station Uttam Nagar. A dispute between petitioner no.1 and respondent no.2 with respect to construction of a property in Uttam Nagar led registration of FIR No.761/2013 under section 324/506/34 IPC at police station Uttam Nagar on the complaint of respondent no.2. It is submitted that petitioners and respondent no.2 have now settled their disputes amicably before the Delhi Mediation Centre, Tis Hazari Courts, Delhi on 5th October, 2016. Respondent no.2 admits the factum of settlement arrived at with the petitioners and submits that he has no objection in case the aforesaid FIR and consequent proceedings emanating therefreom are quashed.

Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed against the petitioner.

Petition is disposed of in the above terms.
