The instant application under Section 439 CrPC has been filed by the petitioner praying for grant of regular bail in case FIR No.542/2017 under Section 323/341/308/34 IPC, PS Gokul Puri, Delhi. 2.

Learned counsel for the petitioner submits that the petitioner is in custody since 21st September, 2017. The injured has suffered simple injury and has been discharged from the hospital on the same day. The petitioner has clean antecedents and is not involved in any other case. Learned counsel for the petitioner has prayed for grant of bail to the petitioner. 3.

Status report has been filed by the State. Alongwith the status report, the State has also filed the copy of the MLC of the injured persons namely Pawan Pal and Kamal.

As per the FIR, the allegations levelled against the present petitioner is that he hit on the forehead of complainant/injured Pawan Pal with an iron rod and on hearing his screams, when his neighbour Kamal came to rescue him, the petitioner also hit on the head of Kamal with the same iron rod. 5.

As per the MLC of injured Kamal, he has suffered injuries near left eyebrow (4.5 X 1 cm) and near left eye. As per the MLC of injured/complainant Pawan Pal, the injured complained of pain in epigastric region. He was discharged from the hospital on the same day. As per the opinion of the doctor, the nature of injuries was simple. 6.

The petitioner is in custody since 21st September, 2017. In the given circumstances, I find it to be a fit case to enlarge the petitioner on bail. The petitioner is directed to be released on bail on his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of learned Trial Court/Link Court.

The bail application is allowed.
