CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 23.10.2017 By the above-noted petitions, petitioners have prayed for quashing of following two FIRs:- a) FIR No. 125/2015 under Section 308 IPC registered at police station Gokul Puri on the complaint of Javed Saifi (respondent no.2 in Crl. M.C. 4263/2017 and petitioner no.1 in W.P. (Crl.) 2929/2017). Besides Javed Saifi, Kamaluddin (respondent no. 3 in Crl. M.C. 4263/2017) had also sustained injuries.

b) FIR No. 124/2015 under Sections 308/323/452/341/509/354/ 354-A/34 IPC registered at police station Gokul Puri on the complaint of Suraj (respondent no. 2 in W.P. (Crl.) 2929/2017 and petitioner no.1 in Crl. M.C. 4263/2017).

Besides Suraj, Aakash, Neelam and Priya (respondent nos. 3 to 5 respectively in W.P. (Crl.) 2929/2017) are also victims.

It is submitted that petitioners and private respondents in both the petitions are neighbours. A quarrel took place between them on some trivial matter, which had led to registration of aforesaid cross FIRs. It is further submitted that petitioners and private respondents have now settled their disputes amicably with the intervention of their common friends in order to maintain harmonious relations in future, therefore, aforesaid FIRs may be quashed.

Injured persons, namely, Javed Saifi, Kamaluddin, Akash, Neelam, Suraj and Priya are present in Court today and have been identified by SI Shailender Singh of police station Gokul Puri. They submit that they have settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion, therefore, they do not wish to pursue the FIRs any further and the same may be quashed. Keeping in view the fact that a quarrel took place between the neighbours which had led to registration of cross FIRs and now they have settled their disputes amicably in order to maintain harmonious relations in

future, in the interest of justice, aforesaid cross FIRs and the consequent proceedings emanating therefrom are quashed.

Both the petitions are disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.

Dasti.
