% 18.02.2020 This matter was listed yesterday when an adjournment was sought on the ground that the Main Counsel for the Respondent is not available. The matter was adjourned to today, however, the Main Counsel is still not available. It is further stated that the Respondent has some medical issue due to which he is unable to assist the counsel.
A perusal of the impugned order dated 6th September, 2017 shows that the delay in filing the appeal is, at best, of a period of five days. In any event, 14th December, 2016 i.e., the date on which a copy of the impugned judgement was informally served on the ld. counsel for the Appellant cannot be counted for the purposes of limitation.
Accordingly, the delay in filing the appeal is condoned and the appeal is restored to its earlier position. Let the appeal now be heard and disposed of on merits by the ld. RCT.
The petition is allowed in the above terms. All pending applications are disposed of.
