CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 22.01.2018 By this petition the petitioner seeks directions to the respondent No.1 to protect the petitioner from respondents No.2 to 4. A Status Report has been filed. As per the Status Report on the complaint of Ms.'A' aged 11 years, FIR was registered against Raja and Monu, both sons of Sartaj Singh who are the neighbours of the petitioner. Statement of victim under Section 161 and 164 Cr.P.C. was recorded. This Court after hearing arguments, granted anticipatory bail to Raja and Monu. Further, another FIR No.157/2017 under Sections 354/506/34 IPC and Section 12 of the POCSO Act was registered at PS Malviya Nagar on the complaint of petitioner against Raja and Monu. The said case was also investigated. Respondent W.P.(CRL) 2932/2017

No.2 Saira Siddiqui, mother of Raja and Monu, also got registered two cases against the husband and family members of the petitioners being FIR Nos.223/2017 and 365/2017. On the complaint of husband and family members of the petitioner case FIR No.234/2017 and 157/2017 have been registered at PS Malviya Nagar against respondents No.2, 3 and 4. Because of the constant quarrel between the parties, Kalandara under Section 107/150 Cr.P.C. has been prepared against both the parties. A perusal of the facts in the Status Report reveals that there are constant quarrels between the neighbours and both are lodging complaints against each other on which actions as required are being taken. In view of the fact that the petitioner's family members are also accused in two FIRs and there are other cases, this Court finds no ground to grant protection to the petitioner. However, the beat staff is required to ensure that peace and tranquillity is maintained in the area and the SHO PS Malviya Nagar is to take action in accordance with law in case of any complaint by any of the parties.

Petition is dismissed.
