% 13.04.2018 IA No. 4928/2018 This application is filed under Order 23 Rule 3 CPC for recording of a settlement between the parties.

The suit was filed against the defendants on account of infringement of the trademark, passing off, dilution, etc. Mr. Deepak Aggarwal, defendant No.1 who is the Director of defendant No.3 Company is present in person. As per the application, the defendants have confirmed that the infringing mark "HAVELLI'S" has not been in use and will not be used in future. The parties have settled their dispute.

Mr.Deepak Aggarwal undertakes on behalf of the defendants to abide by the terms and conditions of the settlement.

The terms and conditions of the settlement are valid and legal. The application is allowed.

CS(COMM) 712/2017 The suit is decreed in terms of the compromise arrived at between the parties.

The suit stands disposed of.
