The learned APP has pointed out the order dated 5.9.2018, passed by the Metropolitan Magistrate (South-West) - 01, Mahila Court, Dwarka, Delhi ('Trial Court') whereby charge was framed against the petitioner for the offences under Sections 354D/ 509 of the Indian Penal Code, 1860 ('IPC') and further, vide a separate order of even date, the Trial Court acquitted the petitioner for the said offences under Sections 354D/509 IPC.

The learned APP further submitted that, in view of the acquittal of the petitioner for the said offences, no case survives against the petitioner now.

In view of the submissions of the learned APP, learned counsel for the petitioner seeks permission to withdraw the petition. Accordingly, the petition is dismissed as withdrawn. CHANDER SHEKHAR, J FEBRUARY 12, 2019 tp
