This Court has issued notice on 27th November, 2018 and the respondents had sought time to obtain instructions. Today, it is submitted on their behalf that the Union of India at present is withdrawing the tender for auction of the Jamkhani Coal Mines, which is subject matter of these proceedings without prejudice to its rights and contentions. 2.

In these circumstances, learned Senior Counsel submitted that the petition is rendered infructuous, except so far as challenge to the notification is concerned.

In case the occasion so arises subsequently to approach the Court, all rights and contentions of the parties in this regard are kept open. 4.
