The learned counsel appearing for the petitioner seeks to withdraw the present petition in view of the specific averments made in the counter affidavit filed by the respondents, to the effect that the petitioner would be eligible for the benefit of paragraph 5(D)(ii) of NPS III from the date the petitioner starts production from gas.

Mr Narula, learned counsel appearing for respondents also confirms that the petitioner would be put at par in terms of the benefits as are available to other manufacturers who have converted their manufacturing process to gas based and are now utilising gas for production of urea. 3.

The aforesaid statement is taken on record and the petition is dismissed as withdrawn.

It is also clarified that the petitioner is not precluded from making an appropriate application before the respondents requesting that the subsidy payable to the petitioner be calculated on the Naphtha feedstock. VIBHU BAKHRU, J SEPTEMBER 20, 2017 RK
