% 28.11.2018 It is submitted that petitioner no.2 is father of petitioner no.1; whereas respondent no.2 is wife of petitioner no.1. Petitioners and respondent no.2 have amicably settled their disputes vide Compromise Deed dated 20.11.2018, therefore, FIR No. 41/2015 under Sections 323/354A/34 IPC registered at police station Jagat Puri and the consequent proceedings emanating therefrom may be quashed.
Respondent no.2 is present in Court along with her counsel. She has been identified by SI Sharfuddin of police station Jagat Puri. She submits that she has settled the matter with petitioners of her own free will and without any undue force, pressure or coercion, therefore, she has no objection in case FIR is quashed. Affidavit of respondent no.2 in this regard is on record.
Keeping in mind the settlement arrived at between petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
