O R D E R

% 24.01.2019 This petition under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the „Act‟) has been filed by the petitioner based on the Arbitral Award dated 14.08.2018 passed by the Sole Arbitrator. Though the respondents have challenged the said Award by way of a petition under Section 34 of the Act, being OMP (COMM) 508/2018, even notice has not been issued on the said petition to the petitioner herein. Also there is no order staying the enforcement of the Award. In my view, therefore, the Award has become enforceable and the appropriate remedy of the petitioner is in form of an Enforcement Petition. The present petition is disposed of granting liberty to the petitioner to take proper remedy.
