% 20.12.2018 By this petition, the petitioners seek quashing of FIR No. 633/2018 under Section 135 of the Indian Electricity Act registered at PS Mehrauli, Delhi on the complaint of officer of respondent No. 1. The plea taken by the petitioners are that the electricity meter of the petitioners had been stolen and an NCR in this regard was registered. The petitioners also lodged a complaint for installing a new meter, however, respondent No. 1 did not install the meter, conducted a surprise inspection and registered the W.P.(CRL) 3753/2018

above noted FIR in question.

Learned Standing Counsel for the respondent No. 1, BSES Rajdhani Power Ltd. on instructions from Mr. Pradeep Baisoya, the Assistant Legal Manager and authorised representative of the respondent No. 1 states that having found out that the error was on account of the non-installation of the meter by the respondent No. 1, the respondent No. 1 has withdrawn the penalty bill raised against the petitioners and does not wish to pursue the abovementioned FIR and the proceedings pursuant thereto. In view of the statement of the authorised representative of respondent No. 2 who is present in Court, is identified by the learned counsel and has signed the order sheet in acknowledgement of the statement made before this Court, FIR No. 633/2018 under Section 135 of the Indian Electricity Act registered at PS Mehrauli, Delhi and proceedings pursuant thereto are hereby quashed.

Petition is disposed of.
