CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 18.02.2019 On the oral prayer made by the learned counsel for the petitioners, coaccused Jitender @ Bittu is impleaded as respondent no. 3 to the lis. Amended memo of parties is taken on record.

Respondent no.2-Rohullah Khan is present in Court with his counsel and has been identified by SI Nishant of police station Sonia Vihar. He submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion, inasmuch as, petitioners have compensated him by paying `20,000/- towards the mental agony suffered by him. He further submits that in view of the settlement he has no objection in case FIR No. 95/2010 under Sections 384/365/323/34 IPC registered at police station Sonia Vihar and the consequent proceedings are

quashed against the petitioners and respondent no.3. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
