CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 31.01.2020 1.

It appears that on the previous date of hearing, erroneously, on behalf of the petitioner, the appearance of Mr. D.S. Mahendru, Advocate was recorded. I am informed that on that date Mr. D.S. Mahendru appeared in two connected writ petitions and not in the captioned writ petition. The connected writ petitions are listed on my board today as well. These writ petitions are numbered as W.P.(C) 7039/2018 & W.P.(C) 7972/2018 and are listed as item Nos.22 and 24 respectively.

2.

This position attains clarity if one were to peruse the order dated 21.1.2019 as also the order dated 2.8.2019.

3.

The record shows that the petitioner in the past has been appearing in person. However, the petitioner has not been appearing in the matter recently. Therefore, ordinarily, I would have dismissed the petition for non-prosecution. Since in the connected matters, I have issued certain directions, to my mind, the petitioner should also have the opportunity of availing the benefit of the same. W.P.(C) 12930/2018

3.1 It is ordered accordingly. The order dated 31.10.2020 passed in W.P.(C)No.7039/2018 and W.P.(C)No.7972/2018 will apply mutatis mutandis to the present petitioner as well.

4.

The writ petition is disposed of in the aforementioned terms. RAJIV SHAKDHER, J JANUARY 31, 2020/pmc W.P.(C) 12930/2018
