% 23.04.2018 It is submitted that matter has been settled between petitioners and respondent no.2 vide Memorandum of Understanding dated 7th July, 2017, therefore, FIR No.435/16 under sections 323/365/34 IPC registered at police station Vasant Kunj (South) may be quashed. Respondent no.2 is present in the Court and has been identified by SI Narender of police station Vasant Kunj (South). He admits having settled the matter with the petitioners voluntarily and without any undue force, pressure or coercion. Respondent no. 2 says that he has no objection in case the aforesaid FIR and the consequent proceedings emanating therefrom are quashed qua the petitioners. Keeping in view the settlement arrived at between the petitioners and respondent no. 2, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No.435/16 under sections 323/365/34 IPC registered at police station Vasant Kunj (South) and the consequent proceedings emanating therefrom are quashed qua the petitioners only.
