BAIL APPLN. 1962/2015 The petitioner seeks bail in FIR No.989/2015 (P.S.
Kotla Mubarakpur) registered under Section 307/506 of the IPC. It has been submitted on behalf of the petitioner that the petitioner and complainant are known to each other from before and because of some dispute, scuffle took place in which the complainant fell down on the floor and received injuries.
The allegation in the first information report is that the petitioner
assaulted the complainant and thereafter threw a big stone on his head resulting in injuries to his person.
The petitioner is in custody since 31.8.2015. Learned counsel for the petitioner has drawn the attention of this Court towards the memorandum of settlement, drawn on 9.9.2015, wherein it has been stated that the dispute between the complainant and the petitioner has been redressed.
The petitioner has agreed to pay the complainant Rs.30,000/- as compensation, which amount has already been paid. Considering the nature of accusation and the settlement arrived at between the petitioner and complainant, this Court is inclined to release the petitioner on bail.
Let the petitioner be released on bail on his furnishing bond in the sum of Rs.10,000/- with two sureties of like amount to the satisfaction of the Trial Court.
Application is disposed of.
