After some arguments, learned counsel for the petitioners submitted that the petitioner No. 2 shall be examined on the next date of hearing i.e. 6th February, 2019, the date already fixed by the Trial Court vide order dated 7th August, 2018.

Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

#3* Learned counsel for the petitioners further submitted that the petitioners, if required, may file an application for the documents and summoning the witnesses for examination.

Learned counsel for the respondent submitted that he has no objection in the examination of petitioner No.2 since the matter is already fixed for the purpose of recording evidence of the accused No.2. It is further submitted by the learned counsel for the respondent that whatever steps and application the petitioners intend to file, they may do so and the learned Trial Court may dispose of the same as per law.

The petitioner No. 2 is directed to examine herself on the next date of hearing before the Trial Court and the Trial Court is directed to expedite the proceedings.

The cost imposed by the Trial Court vide order dated 19.09.20 18 is reduced to Rs. 2000/- in each case as prayed for by the learned counsel for the petitioners.

Learned counsel for the petitioners further submitted that in view of the aforesaid position, he is not pressing the petitions and seeks to withdraw the same.

Accordingly, the petitions are dismissed as withdrawn. Pending applications are also dismissed as withdrawn. However, it is clarified that this Court has not expressed any opinion on the merits of the petitions.
