% 15.01.2019 After some hearing it is submitted by learned counsel for the petitioner the petitioner shall be satisfied if some more time is given to him to vacate the premises, the petitioner shall not press the petition on merits. It is submitted by learned counsel for the petitioners they be given 2 1⁄2 years time to vacate the premises which is accepted by the learned counsel for the respondent provided the petitioner pays the market rental which according to him is 10,000/- per month, however, the same is disputed by learned counsel for the petitioner who says the market rental is 3,000/-. In the circumstances, as an interim measure and looking into the financial position of the petitioner it is directed the petitioner shall pay to the respondent an amount of Rs.2,000/- per month as user/occupation charges w.e.f. 01.02.2016 till 31.12.2018 and an

amount of Rs.3,000/- per month as user/occupation charges w.e.f. 01.01.2019. The user/occupation charges shall be payable on or before 10th of each calendar month and shall be deposited in the same bank account of the respondent. The arrears be paid within eight weeks from today. The water and electricity charges be paid as per actual. The premises shall be vacated by the petitioner on or before 15th July, 2020. The usual undertaking to this effect shall be filed by the petitioner within four weeks from today. Any default of the order would entail eviction forthwith.

In terms of above, the petition along with pending applications stands disposed of.
