% 11.09.2018 The present matter has been listed by the learned Joint Registrar as none had been appearing on behalf of the plaintiff nor any steps had been taken by the plaintiff in compliance with the orders dated 10th April, 2017 and 31st January, 2018.

Learned counsel for defendant states that though the plaintiff no.1 has expired, yet no steps have been taken by plaintiff no.2 to either bring the LRs of plaintiff No.1 on record or to comply with the orders dated 10th April, 2017 and 31st January, 2018. He further states that the defendant does not wish to pursue the present suit as a plaintiff.

Even today none is present for the plaintiffs. Consequently, the present suit for partition is dismissed in default and on account of non-prosecution.
