% 27.10.2017 Respondent no. 2 Meenakshi is present in Court along with her counsel and has been identified by SI Ajay of Police Station Shahbad Dairy. Respondent no. 2 says that she has settled the matter with petitioner no. 1 before the Delhi Mediation Centre, Rohini District Court, Delhi vide a Settlement/Agreement dated 19th November, 2016 as Annexure P-2, of her own free will, voluntarily and without any undue force, pressure or coercion. She submits that her marriage with the petitioner no.1 has already been dissolved by a decree of divorce by mutual consent passed by the Principal
Judge, Family Court, North District, Rohini Courts, Delhi on 5th July, 2017. Petitioner no. 1 has paid Rs.2,00,000/- to respondent no. 2 vide a demand draft towards the balance settled amount. Respondent no. 2 says that entire settled amount has been paid with this payment and she has no objection in case FIR is quashed against the petitioner no. 1 and his relatives, that is, petitioner nos. 2 to 7.
Keeping in mind the facts and circumstances of the case as detailed above more particularly, the fact that marriage between the petitioner no.1 and respondent no.2 has already been dissolved, in the interest of justice, FIR No.292/2012 under Sections 498-A/406/34 IPC registered at Police Station Shahbad Dairy and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
