Mr.Akhil Sibal, Sr.Advocate puts appearance on behalf of the respondent.

During the course of arguments it was informed that the matter is listed before the learned Trial Court for disposal of application under Order XXXIX Rule 1 & 2 CPC filed by the plaintiff and the application under Order XXXIX Rule 4 CPC moved on behalf of the defendant on 14.12.2017.

With the consent of the parties it is ordered that the Trial Court shall dispose of the said application on 14.12.2017 or within a reasonable time thereafter on merits.

It is further agreed that directions contained in the order dated 30.10.2017 shall remain in operation till the disposal of the said applications.

It is, however, made clear that the learned Trial Court shall not be influenced by the observations / directions in the order dated 30.10.2017.

In view of the above learned counsel for the appellant seeks permission to withdraw the present appeal. The appeal is disposed of in the above terms.
