% 11.02.2016 Order impugned before this Court is the order dated 27.08.2015 vide which the right of the petitioner/defendant to cross-examine PW-1 stood closed. It has been brought to the notice that the suit now stands decreed vide judgment dated 08.10.2015. This petition thus no longer survives.

The submission of the learned counsel for the petitioner that he may be permitted to raise these pleas before the RFA Court where the appeal has been filed against the final judgment dated 08.10.2015 may be considered by the said Roster Bench.

Petition disposed of.
